My daughter and Mr. Wilson




Dear Mr Wilson

You wanted to know where my daughter was. I will tell you everything I know. Once upon a time I had a daughter living at home but then she decided to leave me. She was fourteen years old. I can’t describe the feelings your letter of litigation has brought me as I remember that sad time eight years ago when my youngest child walked out of my door for the last time.

I hate you,yes, but I hate more the people who helped my daughter leave my home forever. I’m sending you a few of the letters from the- hated- social services.

I cried for most of last night reading the letters and remembering my daughter. I appreciate it, Mr. Wilson. I will link your name to my misery forever. You can send your men to do what they want to my flat Mr. Wilson, but my daughter will stay lost.

Dear Mr. Wilson
I’m faxing you a few documents for the moment. First my passport, for you to see I’m not my daughter. I’m also sending a letter from the council confirming no one else lives at my address or in other words, I live alone. I’m sending a few more things via a letter.

I have to talk about your bill now. As you are aware, it isn’t my bill and therefore I’m not liable for paying it. This means that any attempt by your company to enforce this alleged agreement will represent a further offence until such time as it can be produced in court.

The law set in the Consumer Credit Act, 1974 must be abided by everyone; people and companies alike and taking the above into consideration, no court would look favourably upon your failure to punish me for something I haven’t done. These letters must cease whilst in dispute, otherwise these can and will be deemed harassment by letter, which again is against the law.

Please note that I am only prepared to communicate with you in writing. Should it be your intention to arrange a "doorstep call", please remember that there is only an implied license under English Common Law for certain people to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.)

Please therefore take note that, I revoke license under English Common Law for you, or your representatives to visit me at my property and if you do so without my permission, you will then be liable to damages for a tort of trespass. You would also be conspiring in a trespass if you sent someone to visit me nevertheless.

Unhappy Help please.

I had a letter arrive through my letterbox recently from a company called 'Ruthbridge Limited'
They give some information, such as Their ref, Their Client, which is Cabot Financial Europe Limited, their Clients Ref and balance, which is 2022.04
It then says We have been instructed by the above named client to retrieve this outstanding balance in full.
Failure to respond to this notice within seven days may result in the following legal action:
- A county court form being issued
- A judgment being obtained, which will accrue costs and interest.
- A Bailiff's warrant may be served for seizure of assets.
- An attachment of earnings / Garnishee Order.
It then goes on to say I must contact them within seven days and payment must be made in full.

So I contacted them, having no idea what this debt is, the person in charge of my case wasn't there at the time, so I left my phone number.
Today He phoned, I asked him what the debt was for and he said that "I had been told before, so how do you intend to pay" this discussion went on for a little while, then He said "phone the police and get a crime reference number", I said "OK but won't they want to know what for?" he said "No, because I'll be phoning the police too" none of this made sense, how can I report a crime when I don't know when that crime is?
Anyway.. He then asked if I lived at an address he had, which I did, but quite some time ago...
He then said that I had a City Financial credit card at that address in 2001, and I had "done a bunk!"

I do need to explain something here, I left my home after a marital break-up, and lived in a small flat (the address he had) for about 3 months, then I moved back into the address I lived at previous to that to be with my children, (my ex-wife had moved away); I can't be certain that I didn't have a credit card, My mind was all over the place! but if I did have a credit card, how did I get it? I had just moved home, I was self-employed and on financial assistance, and surely on my application they would have needed my previous address?!?!?

I asked him to send me details of this debt,telling him that I'm not phoning the police yet, he said He wasn't going to send me any details whatsoever!
In all this time I haven't received any letters from City Financial, Cabot Financial, or from Ruthbridge ltd until now.

I'm at a lost what I should do now.

any advice would be welcome.

Default Equita Bailiffs - Help Needed!

Been having a crap few years but have started to get a grip! Been in arrears with the council tax and they sent us off to Equita, what a lovely bunch they are!! Send us threatening letters although we have already informed them that once the remortgage goes thru will pay them! Finally snapped this morning and composed the following letter, what do you think?


16th August 2006
To Whom It May Concern
Account Numbers 99XXXXX & 10XXXXXX
As previously communicated we are currently awaiting the re-mortgage of our property. This has taken far longer than expected but is due to complete within the next week.
If further details are required please contact our solicitors

Address of solicitors is in here!!

Upon completion the account 99XXXXX with outstanding sum of £800.06 will be paid in full. We are in possession of a payment booklet for the account.
Account 10XXXXX with initial sum £1063.53 will have a large amount paid towards being paid in full. Once this payment has been made we will request it is returned to District Council. We require a payment booklet for this account as we no longer have access to either a cheque book or debit card and will have to pay in cash.
Please confirm the arrival of this letter by return.
Please desist from sending computer generated letters that include phrases such as "despite numerous communications and bailiffs visits" when there has been one letter and no visits as we there is ALWAYS somebody at the house and we would have noticed! This is an exercise in intimidation and as such should stop. Please make all communication relevant and covering of the salient points.
